These conditions govern all study abroad applications made with City and Guilds of London Art School (“the Art School”, “we”, “us”, or “our”), registered in England, with charity registration number 1144708, whose registered office is at 124 Kennington Park Road, London SE11 4DJ. You (“you“, “the applicant“) accept these conditions whether you are applying for yourself or on behalf of others. In addition, by visiting or using our website, you agree to comply with the website terms and conditions.

Please read these study abroad applications terms and conditions carefully before making an application or considering a change to an existing application.

1. CONDITIONS OF APPLICATION

a)      Once we have received your completed application form and supporting materials, we will arrange for your application to be reviewed by our tutors, and if it is approved, we will confirm availability of a place on the course and collect your Administration, Application and Registration fee of £500. Only once you have confirmed in writing your acceptance of our offer, and we have received this payment, is your place on the course confirmed.

b)      Restrictions may apply, including, but not limited to, minimum age restrictions; you will be advised of these at the time of application, where applicable.

c)       We reserve the right to accept or decline your application at our absolute discretion.

 

2. PAYMENT TERMS

a)    Payment must be made by bank transfer and must be made in GBP (pounds sterling) with bank transfer charges borne by the booker. Our bank details are available on request.

b)    Payment of the non-refundable Administration, Application & Registration fee of £500 must be made within 14 days of the date of our offer of a place on the course.

c)    Payment of your tuition fees (after deducting the Administration, Application & Registration fee) must be made no later than 42 days before the start of your course.

3. FEES

a)    Our fees are as published on our website, and are payable in GBP (pounds sterling).

b)    All advertised fees are to the best of our knowledge correct at the date of publication. However, we reserve the right to change any fees from time to time.

c)    If you do not pay your fees in full, you will not be entitled to start your course.

4. CHANGES TO YOUR APPLICATION AND CANCELLATION BY YOU

a)    If you are a consumer as defined by the Competition and Markets Authority, and you are not applying to your course for purposes connected with a business, then you have a legal right under the Consumer Contract (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your course within 14 days without giving a reason. The cancellation period will expire 14 days after the date of our confirmation following receipt of your Administration, Application and Registration fee. We will provide a Cancellation Form for this purpose, although it is not compulsory to use it.

b)    If you cancel your place on the course in accordance with paragraph 4a), we will refund the fees to you. However, if we have started to provide the services to you within the cancellation period, then we will be entitled to charge you a reasonable sum for the services that we have provided, and we will deduct this amount from any refund payable to you.

c)    The other paragraphs of these Terms and Conditions set out your other rights to cancel your course which are in addition to and do not affect your rights under paragraph 4a).

d)    All requests for changes and cancellations must be made in writing directly to us.

e)    If you wish to change any detail of your confirmed place on the course we will do our best to make the change subject to an administration fee of £40 per application which will be payable to us once any change has been made, together with any other resulting costs, for example an increase in the course fees.

f)     All changes to a course application must be made no later than 10 working days before the start of the course, and are subject to availability. Should any change be rejected, your original application will stand. Name changes will not incur any charges or administration fee.

g)    Non-arrival will be treated as a cancellation and you will not be entitled to any refund.

h)    Non-attendance does not entitle you to any refund, extra teaching or a transfer to another course.

i)     If you cancel your place on the course at least 42 days before the course starts, you are entitled to a refund of your fees, less the non-refundable Administration, Application and Registration fee and our administrative charge of £40.

j)     If you cancel your place on the course fewer than 42 days before the course starts, you are not entitled to any refund of your fees.

k)    Payment transaction fees are not refundable in the event of a cancellation.

5. CHANGES TO YOUR APPLICATION AND CANCELLATION BY US

a)    We do not expect to have to make any changes to your course, however occasionally courses have to be changed or errors in information or other details corrected, and we reserve the right to do so. If this does happen, we will contact you by telephone or email.

b)    If you do not wish to accept a change, you may be entitled to cancel your place on the course and receive a refund unless this is the result of an Event beyond our Control – see below. You should tell us as soon as possible whether you wish to accept any change or alternative course offered or alternatively if you want a refund.

c)    Events beyond our Control include but are not limited to the following: acts of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any licence or consent), fire, flood, lightning, explosion, bad weather, epidemic, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations and building work in the local area, strikes, lockouts or boycotts, embargo, blockade.

6. YOUR HOME INSTITUTION

a)    If the course will form part of your course at your home institution, it is important that you speak with your academic advisors before you apply and ensure that the course is approved by them and that they will award credit.

7. RECORDS OF STUDY AND ATTENDANCE

a)    We will issue you with a record of study and attendance in the name specified on your application form, after the end of the course.

8. HEALTH AND SAFETY

a)    We take the health and safety of all our students seriously. On arrival you should familiarise yourself with the layout of the building and the health and safety procedures as detailed by your tutor.

b)    You must comply with our health and safety rules, including wearing suitable clothing and footwear for practical classes.

c)    Any health and safety enquiries can be raised with the Study Abroad Administrator if required.

9. STUDENT RESPONSIBILITY

a)    Study abroad students must abide by the Art School’s regulations, policies and procedures including, though not exclusively, Equality & Diversity, Protecting Dignity & Respect, Upholding Academic Integrity and Freedom of Speech & Creative Expression.

b)    Study abroad students are required to behave in a responsible way, and respect their fellow students and the Art School. They may not cause any sort of nuisance or disruption to fellow students or use threatening or abusive behaviour towards a member of staff on the phone, in writing or in person.

c)   Applications may not be accepted from any students under the age of 18. Proof of identity and date of birth may be requested on arrival and if not presented on request, we reserve the right to cancel your place on the course.

10. VISAS

a)    You must ensure that you have an immigration status that entitles you to join your course. If you require a visa to study with us, we will provide you with a visa letter only once you have paid the required Administration, Application and Registration fee for your course.

b)    We will not allow you to join your course if you require a visa that allows you to study, and do not have one. You must present your passport and your visa to the Study Abroad Administrator before the start of the course.

11. INSURANCE

a)    We are not responsible for the theft of or damage to your personal belongings during your course. Therefore you are advised to ensure you have appropriate insurance in place. In addition you are advised to ensure you have appropriate travel insurance to cover cancellation and medical expenses.

12. LIMITATION OF LIABILITY

a)    Nothing in these terms and conditions shall affect your statutory rights if you are a consumer. Nothing in these terms and conditions limits or excludes our liability for death or personal injury resulting from negligence; or for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by us, or any liability that cannot by law be excluded.

b)    Subject to the paragraph above, we shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss of corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.

c)    Other than in relation to death or personal injury caused by our negligence, or any other liability that by law cannot be excluded or restricted, our liability to you in relation to these conditions is limited to the value of the course application made with us.

13. COMPLAINTS

a)    In the unlikely event that you are dissatisfied with any aspect of our service please notify the Study Abroad Administrator as soon as possible in the first instance. If you do not give us the opportunity to resolve a problem before or during your course, this may affect the final outcome of any complaint received. 14. PRIVACY AND DATA PROTECTION

a)    We will use the personal information you provide to process your payment, provide our services and to tell you about our courses including special offers that we think may be of interest to you.

b)    We will not give your personal data to any other third party, unless your booking has been made through an agent, in which case we may share information with them.

15. GENERAL

a)    We reserve the right to change these conditions from time to time.

b)    If study abroad students are in breach of any of these conditions, we reserve the right to request that students leave the course immediately.

c)    These conditions shall be governed by and construed in accordance with the laws of England and the Courts of England shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these conditions and any matter arising from them.
